Measures for the Administration of Transfer of Rural Land Management Rights
1. During the contract period, the contractor has the right to decide independently whether the land management rights will be transferred, as well as the objects, methods, and duration of the transfer in accordance with the law.
2. The proceeds from the transfer of land management rights belong to the contractor, and no organization or individual may withhold or withhold them without authorization.
3. If the contractor voluntarily entrusts the contract issuing party, an intermediary organization or another person to transfer its land management rights, the contractor shall issue a letter of authorization for transfer. The power of attorney shall specify the matters entrusted, authority and time limit, etc., and shall be signed or sealed by the trustor and the trustee.
4. Without the written authorization of the contractor, no organization or individual has the right to decide to transfer the contractor’s land management rights in any way.
5. The transferee of the transfer of land management rights shall be an organization or individual with agricultural management capabilities or qualifications. Under equal conditions, members of this collective economic organization shall enjoy priority.
6. The method, term, price and specific conditions for the transfer of land management rights shall be determined by both parties to the transfer on an equal footing. After the expiration of the transfer period, the transferee has the priority to renew the contract under the same conditions.
7. The transferee shall protect the land in accordance with relevant laws and regulations and is prohibited from changing the agricultural use of the land. It is prohibited to idle or desolate cultivated land, occupy cultivated land to build kilns or tombs, or build houses, dig sand, quarry, mine, or borrow soil on cultivated land without authorization. It is prohibited to occupy permanent basic farmland to develop forestry and fruit industry and to dig ponds for fish farming.
Measures for the Administration of Transfer of Rural Land Management Rights and Other Matters
The contractor shall not unilaterally terminate the land management rights transfer contract, unless the transferee has one of the following circumstances:
(1) Unauthorized change of agricultural use of land
(2) Abandoning farmland and wasteland for more than two consecutive years
(3) Causing serious damage to the land or seriously damaging the ecological environment of the land
(4) Other serious breaches of contract
Under the above circumstances, if the contractor does not terminate the land management rights transfer contract within a reasonable period, the contracting party has the right to request the termination of the land management rights transfer contract
The transferee shall compensate the damage caused to the land and land ecological environment in accordance with the law.
