The resignation certificate is a certificate of the end of a labor relationship and a certificate of the work experience. According to the provisions of Article 50, Paragraph 1, of the Labor Contract Law of the People's Republic of China, the employer shall issue a certificate of termination of the labor contract when terminating the labor contract; according to the provisions of Article 89 of the Law, if the employer fails to issue such certificate to the employee, it may not only be ordered to make corrections by the labor administrative department, but also shall compensate for the loss if it causes losses to the employee. It can be seen from the above provisions:
First, when the labor contract is terminated, the employer shall promptly issue a certificate of termination of the labor contract to the employee in accordance with the law. This is a post-contractual obligation of the employer strictly imposed by law, and it is by no means the employer's "power" over the employee. If the employer violates this obligation, it must bear corresponding legal liability.
Secondly, when the employer issues a certificate of termination of the labor contract, it is issued to the employee who has resigned. It is issued for the benefit of the employee who has resigned, rather than for the benefit of the employer where the employee will work in the future. The reason why the law stipulates this is because the main functions of the labor contract termination certificate are: first, to present the employee's previous employment information to facilitate the employee's re-employment; and second, to provide unemployment registration for the employee who has resigned.
