Contents of used car circulation management measures
Article 1 These Measures shall apply to those engaged in second-hand car business activities or second-hand car-related activities within the territory of the People’s Republic of China.
The term "second-hand cars" as mentioned in these Measures refers to cars that are traded and ownership is transferred from the time the registration formalities are completed to the time when they meet the national mandatory scrap standards (including three-wheeled cars, low-speed trucks, that is, the original agricultural transport vehicles, the same below), Trailers and motorcycles.
Article 2 A second-hand car trading market refers to a place established in accordance with the law to provide centralized transactions of second-hand cars and related services to buyers and sellers.
Article 3 Second-hand car business entities refer to enterprises that have been registered by the industrial and commercial administration department in accordance with the law and engage in second-hand car distribution, auction, brokerage, appraisal and evaluation.
Article 4 Second-hand car business activities refer to second-hand car distribution, auction, brokerage, appraisal and evaluation, etc.
(1) Second-hand car distribution refers to the business activities of second-hand car dealers to acquire and sell second-hand cars
(2) Second-hand car auction refers to the business activity in which second-hand car auction companies transfer second-hand cars to the highest bidder in the form of public bidding.
(3) Second-hand car brokerage refers to a second-hand car brokerage institution that engages in intermediary, brokerage or agency activities for the purpose of collecting commissions to facilitate others to trade second-hand cars.
(4) Used car appraisal and evaluation refers to the business activities of used car appraisal and evaluation agencies to appraise and evaluate the technical status and value of used cars.
Precautions for Used Car Circulation Management Measures
The following vehicles are prohibited from distribution, sale, auction and brokerage:
(1) Vehicles that have been scrapped or have reached national compulsory scrapping standards
(2) Vehicles under customs supervision during the mortgage period or traded without customs approval
(3) Vehicles that have been seized or impounded by the people's courts, people's procuratorates, and administrative law enforcement departments in accordance with the law
(4) Vehicles obtained through illegal and criminal means such as theft, robbery, and fraud
(5) Vehicles whose engine number, vehicle identification number or frame number do not match the registration number, or where there are signs of tampering
