Contents of the Measures for the Pre-sale Management of Urban Commercial Housing
Article 1 The term “pre-sale of commercial housing” as mentioned in these Measures refers to the behavior in which a real estate development enterprise (hereinafter referred to as the development enterprise) sells a house under construction to a purchaser in advance, and the purchaser pays a deposit or house price.
Article 2 These Measures apply to the management of pre-sales of urban commercial housing.
Article 3 The construction administrative department of the State Council shall be responsible for the centralized management of pre-sale management of commercial housing in cities across the country.
The construction administrative departments of provinces and autonomous regions shall be responsible for the centralized management of pre-sale management of urban commercial housing within their respective administrative regions.
The construction administrative department or the real estate administrative department of the municipal or county people's government (hereinafter referred to as the real estate administrative department) is responsible for the pre-sale management of urban commercial housing within its own administrative region.
Article 4 The pre-sale of commercial housing shall meet the following conditions:
(1) All land use rights transfer fees have been paid and the land use rights certificate has been obtained
(2) Hold a construction project planning license and construction license
(3) Based on the commercial housing provided for pre-sale, the funds invested in development and construction account for more than 25% of the total investment in project construction, and the construction progress and completion delivery date have been determined.
Procedures for the management of pre-sale of urban commercial housing
The pre-sale license for commercial housing shall be handled in accordance with the following procedures:
(1) Acceptance. The development enterprise shall submit relevant materials in accordance with the provisions of Article 7 of these Measures. If the materials are complete, the real estate management department shall issue an acceptance notice on the spot; if the materials are incomplete, a one-time written notification of the materials that need to be supplemented shall be made on the spot or within 5 days.
(2) Review. The real estate management department shall review whether the relevant materials provided by the development enterprise meet the legal conditions.
The development company is responsible for the authenticity of the substantive content of the submitted materials.
(3) Permission. After review, if the application of the development enterprise meets the statutory conditions, the real estate management department shall make a written decision on the administrative license to approve the pre-sale within 10 days from the date of acceptance, send it to the development enterprise, and submit it to the development enterprise within 10 days from the date of making the decision. The enterprise issues and delivers the "Commercial Housing Pre-Sale License".
