A common mistake made in practice is that the receiving company often does not stamp the official seal on the delivery note, but only assigns employees in the warehouse to sign for the delivery note.
3. This situation is very common, but it is risky: if Party B denies that it has received the goods in a lawsuit to collect payment, and also denies that the person who signed for the delivery note is its employee, the labor contract between the consignee and the employee has not been authenticated by the labor department or they have not signed a labor contract. Then the delivery person will not be able to prove that the person who signed the delivery note is an employee of the consignee. In the absence of other circumstantial evidence, he will have to bear the burden of proving the case and lose the case.
