Contents of the Measures for the Registration and Management of Mineral Resources Exploitation

The mining of the following mineral resources shall be subject to the approval, registration and issuance of a mining license by the geological and mineral administrative department of the State Council:

(1) Mineral resources in national planned mining areas and mining areas of important value to the national economy

(2) Mineral resources in territorial waters and other sea areas under China’s jurisdiction

(3) Mineral resources mined by foreign investment

(4) Mineral resources listed in the appendix of these Measures

​​​​​​​​​​​​​​​​​​​​​​​After review and approval by the agency designated by the State Council, the geology and mineral resources department of the State Council will register and issue a mining license.

​​The mining of the following mineral resources shall be approved, registered and issued by the geological and mineral administrative departments of the people's governments of provinces, autonomous regions and municipalities directly under the Central Government, and mining licenses shall be issued

(1) Mineral resources with medium-sized or above mineral reserves other than those specified in paragraphs 1 and 2 of this article

(2) The mineral resources administrative department of the State Council authorizes the geological and mineral administrative departments of the people's governments of provinces, autonomous regions and municipalities directly under the Central Government to review, approve and register mineral resources

The mining of mineral resources other than those specified in paragraphs 1, 2 and 3 of this article shall be approved by the departments responsible for geological and mineral management of the local people's governments at or above the county level in accordance with the management regulations formulated by the Standing Committees of the People's Congresses of provinces, autonomous regions and municipalities directly under the Central Government. When applying for a mining license, an applicant for mining rights shall submit the following information to the registration management authority:

(1) Application for registration and mining area map

(2) Proof of qualifications of mining rights applicants

(3) Mineral resource development and utilization plan

(4) Approval documents for the establishment of mining enterprises in accordance with the law

(5) Environmental impact assessment report on mining mineral resources

(6) Other information required to be submitted by the geology and mineral resources department of the State Council
