Characteristics of ship charter contracts
1. A lease contract is a contract that transfers the right to use the leased property.
In the lease contract, the lessee’s purpose is to obtain the right to use the leased property, and the lessor only transfers the right to use the leased property, but not its ownership; when the lease contract is terminated, the lessee must return the leased property. This is the fundamental feature that distinguishes a lease contract from a sales contract.
2. The lease contract is a bilateral, paid contract.
In a lease contract, there is a consideration relationship between the delivery of rent and the transfer of the right to use the leased property. Rent delivery is the consideration for obtaining the right to use the leased property, and obtaining rent is the purpose of the lessor leasing the property.
3. The lease contract is a promise contract.
The establishment of a lease contract does not require the delivery of the leased object. The contract will be established as long as the parties reach an agreement in accordance with the law.
