Contents of Water Licensing Management Measures

Article 1 In order to strengthen the management of water abstraction licenses and standardize the application, approval and supervision of water abstraction, these Measures are formulated in accordance with the "Water Law of the People's Republic of China" and the "Regulations on the Administration of Water Abstraction Licenses and Water Resource Fee Collection" (hereinafter referred to as the "Water Abstraction Regulations") and other laws and regulations.

Article 2 Units and individuals that draw on water resources, as well as water administrative departments and river basin management agencies and their staff engaged in water drawing license management activities, shall abide by these Measures.

Article 3 The Ministry of Water Resources is responsible for the organization, implementation, supervision and management of the national water abstraction licensing system.

The watershed management agency under the Ministry of Water Resources (hereinafter referred to as the watershed management agency) is responsible for the organization, implementation, supervision and management of the water abstraction permit system within its jurisdiction in accordance with laws, regulations and the management authority specified by the Ministry of Water Resources.

The water administrative departments of local people's governments at or above the county level are responsible for the organization, implementation, supervision and management of the water abstraction licensing system within their respective administrative regions in accordance with the hierarchical management authority stipulated by the people's governments of provinces, autonomous regions and municipalities directly under the Central Government.

Article 4 The total water consumption approved for water withdrawal within the basin shall not exceed the state-approved usable amount of water resources in the basin.

The total amount of water approved for withdrawal within an administrative region shall not exceed the amount of water available for the administrative region issued by the river basin management agency or the water administrative department at the next higher level.

Elements of Water Licensing Management Measures

(1) The reduction in water volume due to water intake may cause the water area where the water intake is located to fail to meet the water quality standards of the water function zone

(2) Setting up sewage outlets into rivers in drinking water source protection zones

(3) The concentration of main pollutants contained in the returned water exceeds the pollutant discharge standards stipulated by the state or local government

(4) The water withdrawal may cause the water discharged into the water area to fail to meet the water quality standards of the water function zone

(5) The water withdrawal does not comply with the total amount of sewage discharge into the water area control requirements

(6) Water withdrawal does not meet groundwater recharge requirements
